DULUX ARABIA INSTAGRAM CONTEST

A. PARTICIPATION

• All persons (“Participants”) entering the Dulux Arabia Instagram contest (“Contest”) agree that the Contest rules, as set out in these terms and conditions (“Terms and Conditions”), shall apply and are binding on them.

• Participation in the Contest is free and no purchase in necessary. The following people shall not be eligible to participate in this Contest:

  1. Directors, members, partners, promotional and advertising agents, merchandisers, employees or consultants of Akzo Nobel Decorative Paints LLC (“Dulux Arabia”).

  2. Immediate family members, business partners or associates of any of the persons specified in (a) above.

  3. People who are not legal citizens of the United Arab Emirates (“UAE”) or people who, at the time of participation in the Contest, do not hold a valid UAE residence visa.

• Persons under the age of 18 years are required to obtain their parents’ consent before participating in the Contest.

• These Terms and Conditions override any advertising collateral or material in the event of any conflict.

   

B. PRIZE

• One (1) grand prize winner will be chosen at the end of the Contest Period and will win one (1) new iPhone XR (64 GB) in the colour of the winner’s favourite colour chip, as mentioned in the winner’s entry post (“Grand Prize”).

• All Participants who participate in the Contest and successfully comply with these Terms and Conditions have the opportunity of winning the Grand Prize.

• At the end of the Contest Period, Dulux Arabia will notify selected Participants directly via Instagram informing them that they have been shortlisted as one of the potential winners, and requesting them to email their contact details to Dulux Arabia’s official email address by the prescribed date. The winner of the Grand Prize will be selected by random draw and will be notified by telephone call or email confirming that they have won, and confirming when and where the Grand Prize can be collected.

• The Grand Prize must be collected by the winner within one (1) month of date of winner announcement, failing which. The winner must produce his/her valid Emirates ID upon collection of the Grand Prize for verification purposes.

• Dulux Arabia reserves the right to redistribute any unclaimed prize to other Participants or donate any unclaimed prize to an approved charitable organization in the UAE.

• The Grand Prize is not transferable and cannot be exchanged for cash, credit or kind or for a different colour or model.

• The winner acknowledges that the Grand Prize has been received in good condition at the point of collection, and Dulux Arabia is in no way responsible for any risks or damages that may occur once the Grand Prize is handed over to the winner.

   

C. ENTRY

• The Contest commences at midnight on 22thPeriod”), subject to any early termination or extension thereof by Dulux Arabia as contemplated in these Terms and Conditions.

• To enter the Contest, Participants must:

  1. Follow @DuluxArabia on Instagram;

  2. Tag three (3) friends in the relevant @DuluxArabia Instagram post (“Contest Post”) and ask them to follow @Dulux Arabia on Instagram; and

  3. Comment below the Contest Post with their favourite colour.

• Participants must set their Instagram account visibility to ‘public’ in order to participate in the Contest.

• All entries must be submitted within the Contest Period, in accordance with these Terms and Conditions. Entries submitted after the Contest Period will not be valid. Dulux Arabia accepts no responsibility for late, lost, delayed or misdirected entries.

• Entries with negative content/captions will be disqualified.

D. GENERAL

• This Contest is in no way sponsored, endorsed or administered by, or associated with, Apple, Instagram or any other social network. Apple and iPhone are trademarks of Apple Inc.

• Dulux Arabia’s decision in respect of all matters concerning the Contest is final, and no correspondence will be entered into.

• By entering this Contest, each Participant authorises Dulux Arabia to collect, store and use (but not share) personal information of Participants for communication or statistical purposes. Any personal data submitted by Participants will be used solely in accordance with current data protection legislation and Dulux Arabia’s privacy policy.

• Details of the winner (including full name and image) will be published on the official Dulux Arabia Instagram page. The winner agrees to the use of his/her name and image in any publicity material for broadcast or publishing purposes. The winner will not be entitled to any payment or other remuneration for such publicity and all publicity and other materials will be the sole property of Dulux Arabia.   

• The Promoters will continuously monitor any irregular behaviour, whether it be in entries or Participants’ details. Consequently, any violation or attempt and/or suspicion of violation or irregular behaviour and/or non-compliance with these Terms and Conditions will result in immediate disqualification of the Participant.

• The Participant acknowledges that he/she has been given an appropriate opportunity to first read these Terms and Conditions and that he/she understands and accepts these Terms and Conditions.

• All Participants participate entirely at their own risk. By reading and accepting these Terms and Conditions, the Participant gives consent to these risks and hereby indemnifies and holds harmless Dulx Arabia, its directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Contest and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of Dulux Arabia.

• Dulux Arabia, its directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than Dulux Arabia.

• Dulux Arabia reserves the right to terminate or extend the Contest at any time. In the event of such termination or extension, all Participants agree to waive any rights that they may have in terms of the Contest and acknowledge that they will have no recourse against Dulux Arabia, its advertising agencies, advisors, suppliers and nominated agents.

• Notwithstanding anything to the contrary contained in these Terms and Conditions, Dulux Arabia reserves the right to amend, modify, change, postpone or suspend this Contest and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which Dulux Arabia deems necessary. At the end of the Contest, for whatsoever reason, all of Dulux Arabia’s obligations in regard to the Contest shall cease to exist.

• Dulux Arabia’s General Terms and Conditions (available at www.duluxarabia.com/instagramcontest ) are deemed to be incorporated herein and shall apply to the Contest.

• The Contest and these Terms and Conditions will be governed by UAE Federal Law and any disputes will be subject to the exclusive jurisdiction of the courts of Dubai.
